我國職棒發展之相關法律問題探討本研究主要是以社會學，法律社會學及法解釋學的觀點來探討職棒放水事件所發生的問題．在問題的呈後，進行分析問題的成因與法院的判決相對照．對於問題的解析中，主要是以訪談加以論證．在判決的對照上，是以台北地方法院的第一審判決為依據．綜合訪談及長期觀察的結果，並參照法院的判例解釋．對於球員放水的原因及職棒放水事件可能觸犯的法律條文，歸納的結果如下：一在有關台灣的刑法方面，除了一審判決對被告做詐欺及詐欺未遂的判決外，職棒球員的放水行為尚可能適用背信罪．二在契約的約定上，職棒的不公平競爭，以觸犯公平交易法第十九條第三款的不公平競爭及第二十四條的概括條款最有可能．三在球團與球員契約履行的仲裁條款上，有關任何爭議均有球團仲裁，可能產生球團以聯合行為壟斷球員的權利．四在球員的放水原因上，惡徒的脅迫是造成職棒球員不得不犯法的主要原因，此原因不為社會上大多數人所認同．五在球員的義務方面，球員應與球團結合成生命共同體，以尋求比賽中最佳的演出為目的．在有關法務，宣傳及行

This research highlights the problems shown in the recent cheatingsin baseball games from the point of view of Sociology, Sociology of law and Interpretation of law. After the demonstration of theseproblems, the analysis is based mainly on interviews and the decis-ion of the Taipei Distric Court..According to interviews, the long-term observation and the legalinterpretion of the court, the cause of the cheatings and the offe-nce most possibly involved are listed below:1)As a matter of criminal law, in addition to the charges of fraud and attempt fraud against the defendants raised in the first tiral,players'cheating acts possible have anthoritatived violation of trust as well.2)Concerning the conditions regulated in the contract, the unfair competition has most possibly incurred the charge of unfair compet-ition in the third item of article 19 of the Law of Fair Transacti-ons and article 24 of the same law.3)Regarding to the arbitration agreement between the baseball comp-anies and players, since any dispute is to be arbitrated by the baseball companies, they are inclined to get united in order to mo-nopolize the rights of the players.4)Returning back to the cause of the cheatings on the part of the players, threats from bandits are the most common reason. However,most people do not sympathize with them.5)On the obligations of the players, players and the baseball comp-anies should cooperate for the purpose of the best performance inthe same. The legal issues, promotions and the itineraries are to be handled by agents or professionals.
